These Terms govern your use of debtvalidate.com and the phone number displayed on it (the "Service"), operated by Rainy Day Company LLC dba HeyDay Digital Media, operator of DebtValidate.com ("DebtValidate.com," "we," "us"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What the Service is — and isn't

What we do. DebtValidate.com is a consumer-education and matching site. It connects people dealing with collections to independent debt-relief providers, such as consumer-law firms, debt settlement companies and credit repair organizations.

Disclosure. DebtValidate.com is not a law firm, does not provide legal, tax or financial advice, and is not a debt settlement, credit counseling or credit repair organization. Participating providers are independent and are not employees or agents of this website. No attorney-client relationship is formed by using this site. Results vary and are not guaranteed; not every debt can be verified, reduced or removed. This website is not affiliated with, endorsed by, or connected to the Consumer Financial Protection Bureau, the Federal Trade Commission or any government agency. You can dispute a debt directly with a collector yourself at no cost; free sample letters are available at consumerfinance.gov.

Independent providers. Participating providers are independent. We do not employ them, supervise them, or vouch for their qualifications, and we do not promise that any provider will accept your situation.

Any relationship is with the provider. Submitting a form, calling us, or being contacted by a participating provider does not create a client or representative relationship with us. Any such relationship is formed only if you and a provider sign an agreement with each other.

Fees. Our Service is free to you. Any provider fees are explained to you by the provider, in writing, before you sign anything. Confirm all terms in writing with the provider before agreeing to anything.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service.

3. Consent to be contacted

When you submit a form and check the consent box, or when you call us, you give your express written consent to be contacted by DebtValidate.com and its participating providers at the phone number and email you provide, including by automated calls, prerecorded messages and text messages, about debt relief options, even if your number is on a federal or state Do Not Call list. 4. Your information

You agree that the information you submit is accurate, that you are the person it describes, and that you have the right to provide it. We document your consent using third-party verification services described in the Privacy Policy. Submitting false information, or information about someone else without their permission, is a violation of these Terms.

5. Acceptable use

You may not use the Service to submit spam, test, or fraudulent inquiries; to scrape, crawl, or copy content or data; to interfere with the site's operation or security; to impersonate anyone; or for any unlawful purpose. We may block or rate-limit access we believe violates these Terms.

6. Intellectual property

The site's content, design, logos, and code belong to us or our licensors and are protected by copyright and trademark law. You may view and print pages for personal, non-commercial use. Any other use requires our written permission.

7. Third-party links and services

The Service may link to the websites of providers, government agencies, or other third parties. We are not responsible for their content, privacy practices, or services.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PROVIDER WILL CONTACT YOU OR ACCEPT YOUR SITUATION.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEBTVALIDATE.COM AND ITS OWNERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF THE SERVICE OR FROM THE ACTS OR OMISSIONS OF ANY PARTICIPATING PROVIDER OR PARTNER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US TO USE THE SERVICE, IF ANY. Some states do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.

11. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Placer County, California, and you consent to their jurisdiction.

12. Changes to the Service or Terms

We may modify or discontinue the Service at any time. We may update these Terms; the "Last updated" date shows the current version, and continued use after changes means you accept them.
